Juvenile Drug Court

The Juvenile Drug Court Program is a comprehensive and intensive outpatient treatment program designed to help prepare juveniles struggling with addiction lead a drug-free lifestyle, build life skills, continue their education, and strengthen a family's ability to provide structure. The program provides comprehensive supervision, drug testing, treatment services, and immediate sanctions and incentives. Participation in this program is a privilege and requires a commitment from the juvenile and their family. Members of the Juvenile Drug Court Team are present to provide guidance and assistance. However, in order to be successful in this program, the juvenile must be motivated to make positive changes and commit to lead a responsible life.

The program consists of three phases, each of which can be completed within 2-4 months. An individualized treatment plan is developed by the treatment providers. The plan will outline goals that must be reached before advancing to the next phase.

Applicant Information

To be considered for The Juvenile Drug Court Program, the Solicitor, your lawyer and any victims associated with your charges must agree to Drug Court as an option. You must be clinically assessed by a Drug Court treatment counselor.

NOTE: Only certain current charges are eligible for Drug Court and certain items on your prior criminal record may make you ineligible.

YOU MUST BE ADJUDICATED DELINQUENT UPFRONT TO YOUR CURRENT CHARGES AND ACCEPT THE NEGOTIATED DISPOSITION THAT WILL BE IMPOSED IF YOU FAIL OUT OF DRUG COURT.

Charleston County Juvenile Drug Court consists of the following:

• Attend Drug Court on Monday at 4:45 pm at the Judicial Center, downtown.

• Attend treatment sessions approximately 2 times per week.

• Call for drug testing Monday-Saturday and submit to a urine drug screen if on the list. o Low Country Drug Screening, North Charleston.

• Hair testing at the discretion of the Court and prior to any phase move.

• Attend school and cooperate with school regulations, including maintaining grades to the best of your ability and refraining from receiving any discipline referrals, unexcused tardiness, and unexcused absences.

• Pay back all restitution that may be ordered with associated charges and cooperate with all terms of your probation order.

*Failure to comply with any of the above will result in sanctions (detention, community service, written work, etc.)

Successful completion and "graduation" from the program will result in either your charges being dismissed or your release from probation.

Custody Orders and/or new arrests and charges could result in being terminated from the Charleston County Juvenile Drug Court Program and you will immediately begin serving your pre-negotiated sentence. Other violations that could result in termination include consistently missing and/or failing numerous drug tests and/or hair tests or demonstrating a lack of program participation by failing to cooperate with the treatment counselor and working through the program. You DO NOT get credit for your time spent in Drug Court. The Drug Court Team will make all decisions regarding termination from the program.

To apply to Drug Court, please notify your lawyer for a referral.
